    The death of loved ones or breadwinners should not leave a problem and difficult life for the living.Where there is a written WILL. The law protects the interest of the survivors from the greedy relatives and gold diggers and laid out procedures for taking ownership of the property of the dead.Many couples are not married under the Marriage Act of Nigeria but married according to their native customs/tradition; “igba-nkwu”, “Igbeyawo”, “Idana” or “church blessings”. However in the scenerio in my previous post, https://lnkd.in/dWys9FjVWhen a man dies without a WILL traditional laws will prevail instead of our modern and equitable WILLS laws.However when a man who was married under the marriage Act of Nigeria dies, whether a WILL was made or not he is bound by the provisions of the WILLS ACT and not under any native custom/traditionWhere there is no WILL, the court will on its own determine persons to manage and benefit from the property/estate of such a deceased person. This Administrator will be appointed by the court through a Letter of Administration.A Letter of administration will counter and prevail over person ordinarily appointed next of kin by a deceased because appoint of next of kin is not a WILL.That being said, under the Law of succession in Nigeria, where a person contracts a marriage under the Marriage Act, the lawful wife and her children were the only persons entitled to his property and as beneficiaries of the estate they were entitled to the grant of Letters of Administration. In effect, the applicable law was English law and not the Urhobo Customary Law Section 49(5) states that, “Where any person who is subject to Customary law contracts a marriage in accordance with the provisions of the Marriage Act and such person dies intestate after the commencement of this Law leaving a widow or husband or any issue of such marriage, any property left shall be distributed in accordance with the provisions of this Law, any customary law to the contrary notwithstanding.” Section 36(1) of the Marriage Act states that, “where any person who is subject to customary law contracts a marriage in accordance with the provisions of this Act and such person dies intestate leaving a widow or husband or any children of the marriage, the real and personal shall be distributed in accordance with the provisions of the Laws of England relating to succession of estates, notwithstanding any contrary customary law.” “It is not disputed that the Mr and Mrs Hostag were married under the Marriage Act but that prior to that marriage both parties were subject to Agbor Customary Law.
