Thrilled to announce that my and my colleagues' latest piece on Law360 just went live today! This article dives deep into the recent updates on government enforcement guidance announced at the ABA White Collar Institute in San Francisco, with a particular focus on enforcement efforts around cutting-edge technology and artificial intelligence.As the world of AI and other so-called "disruptive technologies" continue to evolve at breakneck speed, so too do the surrounding legal and regulatory landscapes. This article explores the key areas where the DOJ, USAOs, SEC, and National Security Division are cranking up enforcement efforts, including:Modifying whistleblower and amnesty programs to more effectively induce individuals to report AI and intellectual property-related misconduct and other federal criminal activity to the government;Mandating new risk assessments and risk mitigation efforts in the use of AI tools and the introduction of AI-related products into the market; andIntroducing a new enforcement regime that will impose criminal penalties for mishandling datasets--the key fuel that powers AI--containing certain types of personal information, including when companies allow those key tranches of data to fall into the hands of the nation's adversaries.These are just a few of the critical issues addressed in this piece. If you're working at the intersection of law and technology, this is must-read material.As friends and colleagues know, in previous years and presentations I've called these incremental compliance updates "memo fatigue" given the marginal increased annual demands on corporate compliance programs that are usually issued at this conference.
